These Terms of Service ("Terms") govern your use of https://edahartist.com (the "Website") and any purchase of artworks, prints or commissions from Edah.Artist, operated by EDAH ART ENTERPIRSE ("we", "us", "our"), based in Lagos, Nigeria. By using the Website or placing an order, you agree to these Terms. If you do not agree, please do not use the Website.

1. Using the Website

You must be at least 18 years old to place an order. Some artwork on the Website contains nudity, so the Website is not recommended for anyone under 18. You agree to use the Website lawfully and not to:

• copy, scrape or harvest content from the Website in bulk;
• interfere with the Website's security or normal operation;
• submit false information or use another person's payment details without permission.

2. Artworks and product descriptions

Our work is handmade. Colours may look different on your screen than in person, and small variations in texture, size and finish are part of the character of each piece. We take care to describe and photograph each item accurately, but we cannot guarantee that every detail will match your screen exactly. Original artworks are one-of-a-kind; prints may be produced in limited editions as described on the product page.

3. Prices and payment

• Prices are shown in US dollars (USD) unless stated otherwise.
• Prices do not include shipping, taxes, or import duties unless stated. These are shown or calculated at checkout where possible.
• Payments are processed securely by Bachs. We do not receive or store your full card details.
• If we discover a pricing or listing error, we may correct it and contact you before proceeding; if you no longer wish to buy at the correct price, we will cancel the order and refund you in full.

4. Orders and availability

Placing an order is an offer to buy. We accept it when we send an order confirmation or dispatch the item. Because original works are one-of-a-kind, if a piece is no longer available when your order is processed we will tell you promptly and refund you in full.

5. Shipping and delivery

• We ship using carriers such as DHL / FedEx / local courier. Delivery times are estimates, not guarantees, and may be affected by customs, weather or carrier delays.
• You are responsible for providing a correct and complete delivery address, and for any customs duties, import taxes or clearance fees charged by your country.
• Risk of loss or damage passes to you on delivery. If an item arrives damaged, please follow the steps in our Refund & Returns Policy.

7. Commissions

Custom work is subject to the following, in addition to the rest of these Terms:

• We will agree the subject, size, medium, price and estimated timeline with you in writing before work begins.
• A deposit of 50% is required to begin a commission, with the balance due before the finished piece is shipped (unless we agree otherwise in writing).
• We will share a sketch or concept for your approval. Reasonable adjustments at that stage are included; major changes after approval may change the price and timeline.
• You keep creative trust in the artist: the final piece is an interpretation of the agreed brief, not an exact replica of any reference.
• Timelines are estimates and depend on how quickly you respond with feedback and approvals.
• We may photograph and share the finished work (for example in our portfolio and on social media) unless you ask us in writing not to.
• Cancellations and refunds for commissions are covered in the Refund & Returns Policy.

8. Intellectual property

All artworks, photographs, text, logos and other content on the Website are protected by copyright and belong to EDAH ART ENTERPIRSE unless stated otherwise.

• Buying a physical artwork gives you ownership of the object itself. It does not transfer copyright or the right to reproduce, publish, print or make merchandise from the artwork. You are free to display, gift or resell the physical piece.
• Prints are sold for personal, non-commercial use.
• You may not copy, modify, distribute or use our images or artwork (including to train machine-learning models) without our written permission.

9. Your messages and submissions

If you send us messages, commission briefs or reference images, you confirm you have the right to share them and allow us to use them to respond to you and carry out the work. We will not publish your personal messages.

10. Third-party services and links

The Website may link to or display content from third parties (for example Instagram) and relies on providers such as payment processors and couriers. We are not responsible for their content, availability or policies, which are governed by their own terms.

11. Disclaimers and limitation of liability

To the fullest extent permitted by law, the Website is provided "as is" and we are not liable for indirect or consequential loss, or for loss caused by events outside our reasonable control. Our total liability in connection with any order is limited to the amount you paid for that order.

Nothing in these Terms excludes or limits any liability, or any of your rights as a consumer, that cannot be excluded or limited under applicable law, including the Federal Competition and Consumer Protection Act 2018 of Nigeria.

13. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top shows when they last changed. Orders are governed by the Terms in force when you place them.

14. Governing law and disputes

These Terms are governed by the laws of the Federal Republic of Nigeria. If you have a complaint, please contact us first so we can try to resolve it informally within 30 days. If that does not work, the courts of Lagos State have jurisdiction, without affecting any mandatory consumer rights you have under the laws of the country where you live.
